Jury Awards Nursing Home Whistle-Blower $5.2 Million

A Livingston County, Illinois jury awarded $5.2 Million to a nurse who was fired from a nursing home for refusing to over-medicate residents and refusing to delete problematic resident records. Kartina Wesemann, a Licensed Practical Nurse, was told by her Director of Nursing to ‘drop a pill’ or double-dose agitated residents with anti-anxiety medications. The D.O.N. also told her to delete or omit records of suspicious injuries of residents. When Ms. Wesemann refused to do these things, she was fired. She then brought suit against the nursing home chain that employed her, Heritage Enterprises, Inc. The Jury awarded her past wages and benefits, and $5 Million in punitive damages.
